Terms of Service

1. Acceptance of Terms

By accessing or using the BiltyMitra mobile application, support portal, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

BiltyMitra is a digital platform designed to help participants in the transportation and logistics industry manage trips, trucks, drivers, digital Bilty/Lorry Receipts (LR), expenses, financial records, and related operational information.

These Terms apply to all users of BiltyMitra, including transport companies, fleet operators, truck owners, drivers, and other authorized users.

If you do not agree with these Terms, you must not access or use the Service.

2. Eligibility and User Roles

BiltyMitra may be used by different participants in the transportation ecosystem, including:

• Transport Companies: Businesses that manage transportation operations, trucks, drivers, trips, Biltys, customers, and financial or operational records.
• Truck Owners: Individuals or businesses who own or manage one or more commercial trucks and use BiltyMitra to manage trucks, trips, drivers, expenses, and related records.
• Drivers: Authorized drivers who use BiltyMitra to view or manage assigned trips, truck information, trip-related activities, and other features made available to them.
• Other Authorized Users: Employees, representatives, accountants, managers, or other persons authorized by a transport company or truck owner to access the Service.

You are responsible for ensuring that you are authorized to use the account, organization, truck, driver, trip, and other information you access through BiltyMitra.

3. Google Account Login and Authentication

BiltyMitra uses Google Sign-In for user authentication.

BiltyMitra does not use mobile-number-based OTP authentication as the primary login mechanism.

By signing in with Google, you authorize the applicable Google authentication service to provide the necessary account information required to authenticate you with BiltyMitra.

You are responsible for:

• Maintaining the security of your Google account.
• Not sharing your Google account credentials with other persons.
• Ensuring that the Google account used to access BiltyMitra belongs to you or has been authorized for your use.
• Immediately taking appropriate action if you believe your Google account has been compromised.

BiltyMitra is not responsible for unauthorized access resulting from compromised Google accounts, shared credentials, or actions taken through a user's Google account.

4. Transport Company and Fleet Management

Transport companies and fleet operators may use BiltyMitra to manage transportation operations, including trucks, drivers, trips, Biltys/Lorry Receipts, expenses, parties, and other operational records.

Organizations are responsible for:

• Providing accurate business and operational information.
• Ensuring that employees and representatives accessing the organization account are authorized.
• Managing user access appropriately.
• Ensuring that information entered by their employees, drivers, or representatives is accurate.
• Maintaining appropriate internal controls over financial and operational records.

BiltyMitra acts as a software platform and does not become a party to transportation contracts between transport companies, customers, truck owners, drivers, consignors, consignees, or other parties.

5. Truck Owners

Truck owners may use BiltyMitra to manage their trucks, assigned drivers, trips, expenses, and related records.

Truck owners are responsible for:

• Providing accurate truck and ownership information.
• Ensuring that drivers assigned to their trucks are properly authorized.
• Verifying trip, freight, expense, and payment information entered into the Service.
• Ensuring that truck and driver information remains accurate.
• Complying with applicable transportation, taxation, insurance, licensing, and regulatory requirements.

BiltyMitra does not independently verify ownership, truck documentation, driving licenses, permits, insurance, fitness certificates, or other legal documents unless a specific verification service is expressly provided.

6. Drivers

Drivers may use BiltyMitra to access information and functionality related to trips or trucks assigned to them.

Drivers are responsible for:

• Using only accounts and information they are authorized to access.
• Providing accurate information when requested.
• Reviewing trip-related information before confirming or submitting it.
• Keeping their Google account secure.
• Not modifying, accessing, or sharing information belonging to other users without authorization.

Drivers must not use BiltyMitra to misrepresent trips, truck information, cargo information, expenses, payments, delivery status, or other operational details.

7. Digital Bilty / Lorry Receipt

BiltyMitra provides tools for creating, storing, managing, and sharing digital Biltys/Lorry Receipts (LRs) and related transportation records.

Users are solely responsible for ensuring that information entered into a Bilty or LR is accurate and corresponds with the underlying physical and commercial transaction.

This may include, where applicable:

• Bilty/LR number.
• Consignor and consignee information.
• Truck number.
• Driver information.
• Origin and destination.
• Goods or commodity description.
• Quantity and weight.
• Invoice details.
• E-Way Bill information.
• Value of goods.
• Freight and other charges.
• Tax-related information.
• Delivery or trip information.

BiltyMitra does not guarantee that information entered by users is correct, complete, legally compliant, or consistent with physical cargo, invoices, E-Way Bills, or other documents.

Users remain responsible for verifying documents before relying on or presenting them to customers, authorities, carriers, or other parties.

8. Tax, GST and Regulatory Compliance

BiltyMitra may provide features that assist users in recording or managing information related to GST, E-Way Bills, invoices, freight, and other transportation records.

These features are provided as software tools and do not constitute tax, legal, accounting, or regulatory advice.

Users are solely responsible for complying with applicable laws and regulations, including requirements relating to:

• GST and applicable taxes.
• E-Way Bills.
• Invoices.
• Transportation documents.
• Commercial truck regulations.
• Driver and truck documentation.
• Weights, measurements, and cargo declarations.
• Record retention.
• Any other applicable central, state, or local requirements.

Users should consult an appropriately qualified professional when legal, tax, or accounting advice is required.

9. Trips, Assignments and Operational Records

BiltyMitra may allow users to create and manage trips, assign trucks and drivers, record trip status, and maintain related operational information.

Users are responsible for ensuring that:

• Drivers are assigned only to appropriate trips.
• Truck information is accurate.
• Trip information is accurate.
• Trip status is updated appropriately.
• Expenses and other financial information are entered correctly.
• Information is not intentionally falsified or manipulated.

BiltyMitra does not guarantee the physical completion, safety, legality, or commercial success of any transportation trip managed through the Service.

10. Expenses and Financial Information

BiltyMitra may provide features for recording trip expenses, advances, payments, freight, or other financial information.

Such records are based on information entered or submitted by users.

Users remain responsible for verifying:

• Expense amounts.
• Payment information.
• Freight amounts.
• Advances.
• Outstanding balances.
• Supporting documents.
• Financial calculations and records.

BiltyMitra is not a bank, payment institution, lender, insurer, or financial advisor unless expressly stated otherwise for a specific service.

11. User-Provided Information

You agree to provide accurate, current, and complete information when using BiltyMitra.

You must not knowingly provide:

• False or misleading information.
• Fraudulent transportation records.
• Falsified invoices or Biltys.
• Incorrect truck or driver information intended to mislead another party.
• Information that you do not have authorization to submit.

You are responsible for reviewing information before submitting or sharing it through the Service.

12. Account and Access Restrictions

You must not:

• Access another user's account without authorization.
• Attempt to bypass authentication or security mechanisms.
• Reverse engineer or attempt to extract the source code of the Service.
• Interfere with the operation or availability of BiltyMitra.
• Upload malicious software or harmful content.
• Use the Service for fraudulent or unlawful activities.
• Scrape or systematically collect information from the Service without authorization.
• Use the Service to impersonate another person or organization.

BiltyMitra may suspend or restrict access where reasonably necessary to protect users, the Service, data, or the integrity of the platform.

13. Data and Records

BiltyMitra may store information submitted or generated through the Service, including account information, organization information, truck information, driver information, trip records, Biltys/LRs, expenses, and other operational data.

Users are responsible for maintaining their own appropriate backups of important business records where necessary.

While BiltyMitra will take reasonable measures to maintain the availability and security of the Service, no online service can guarantee that data will never be lost, corrupted, unavailable, or affected by technical failures.

14. Third-Party Services

BiltyMitra may integrate with or rely upon third-party services, including Google authentication and other infrastructure, hosting, communication, analytics, storage, or software services.

Your use of third-party services may be subject to the terms and privacy policies of those third parties.

BiltyMitra is not responsible for failures, interruptions, or changes to third-party services outside its reasonable control.

15. Intellectual Property

The BiltyMitra application, website, branding, logos, designs, software, source code, interfaces, documentation, and other platform materials are owned by or licensed to BiltyMitra and/or its applicable rights holders.

Except as expressly permitted, users may not copy, reproduce, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from BiltyMitra's software or proprietary materials.

Users retain responsibility and applicable rights over information and content they submit to the Service.

16. Service Availability

BiltyMitra aims to provide a reliable service but does not guarantee uninterrupted or error-free operation.

The Service may occasionally be unavailable because of:

• Maintenance.
• Software updates.
• Infrastructure failures.
• Network problems.
• Security incidents.
• Third-party service outages.
• Force majeure events.
• Other circumstances beyond reasonable control.

BiltyMitra may modify, suspend, or discontinue features of the Service when reasonably necessary.

17. Disclaimer

BiltyMitra is provided as a technology platform to assist with transportation and logistics operations.

BiltyMitra does not guarantee:

• The accuracy of information entered by users.
• The legality or validity of a user's transportation transaction.
• The physical delivery of goods.
• The safety of a truck, driver, cargo, or trip.
• The accuracy of third-party information.
• Compliance with every applicable legal or regulatory requirement.
• Continuous or uninterrupted availability of the Service.

Users are responsible for independently verifying important business, financial, transportation, tax, and legal information.

18. Limitation of Liability

To the maximum extent permitted by applicable law, BiltyMitra and its operators, owners, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive losses arising from the use of or inability to use the Service.

This includes, where legally permissible, losses resulting from incorrect user-entered information, business decisions, transportation disputes, lost profits, loss of business, data loss, service interruptions, or unauthorized access resulting from circumstances outside BiltyMitra's reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

19. Account Termination and Data Deletion

Users may request deletion of their BiltyMitra account through the available Support Portal or by submitting an Account Deletion Request through the applicable support process.

Upon verification, account-related information may be deleted within 7 working days, subject to technical limitations and legally required retention obligations.

Certain records may need to be retained for tax, accounting, legal, regulatory, fraud-prevention, dispute-resolution, or other legitimate purposes.

BiltyMitra may suspend or terminate accounts that violate these Terms, applicable laws, or security requirements.

20. Changes to These Terms

BiltyMitra may update these Terms from time to time to reflect changes to the Service, applicable laws, business practices, or security requirements.

The updated Terms will be made available through the Service or applicable website. Continued use of BiltyMitra after an update constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the applicable laws of India.

Any disputes arising in connection with the Service or these Terms shall be subject to the jurisdiction of the courts having appropriate jurisdiction under applicable Indian law.
